These Terms of Service ("Terms") govern your use of HyperClaw, operated by Crustafarian AI LLC ("Company", "we", "us"). By using our service, you agree to these Terms.
1. Service Description
HyperClaw provides automatic failover infrastructure for AI agents. We monitor your local AI agent and route traffic to a cloud backup when your local instance becomes unavailable.
2. Account Registration
To use HyperClaw, you must:
- Be at least 18 years old
- Provide accurate registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
You are responsible for all activity that occurs under your account.
3. Acceptable Use
You agree NOT to use HyperClaw to:
- Violate any applicable laws or regulations
- Infringe intellectual property rights
- Transmit malware, spam, or harmful content
- Attempt to gain unauthorized access to our systems
- Interfere with other users' access to the service
- Resell the service without our written permission
4. Pricing and Payment
Plans:
- Free: Health monitoring and alerts only
- Pro ($49/month): Full failover with 10 hours included
- Business ($99/month): Full failover with 50 hours included, priority support
Overage: Cloud runtime beyond included hours is billed at $0.15/hour.
Billing: Subscriptions are billed monthly. You authorize us to charge your payment method on file.
Refunds: Subscription fees are non-refundable except where required by law. If failover fails due to our error, contact support for a credit.
5. Service Level
We strive for high availability but do not guarantee 100% uptime. Our target is:
- Monitoring: 99.9% availability
- Failover Initiation: Within 2 minutes of detecting local downtime
For Business plan customers, additional SLA terms may apply as specified in your service agreement.
6. Data and Security
Your Data: You retain ownership of all data you provide. We store encrypted copies for failover purposes.
Zero-Knowledge: Secrets (API keys) are encrypted client-side. We cannot access the plaintext.
Deletion: Upon account termination, your data is deleted within 30 days, except as required for legal or billing purposes.
7. Intellectual Property
HyperClaw and its original content, features, and functionality are owned by Crustafarian AI LLC and protected by copyright, trademark, and other laws.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
We are not responsible for damages resulting from: your local infrastructure failures, third-party service outages (Telegram, Discord, etc.), or your misuse of the service.
9. Indemnification
You agree to indemnify and hold harmless Crustafarian AI LLC from any claims arising from your use of the service or violation of these Terms.
10. Termination
By You: You may cancel your subscription at any time through your account dashboard. Access continues until the end of your billing period.
By Us: We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with 30 days notice.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email at least 30 days in advance. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes will be resolved in the courts of Travis County, Texas.
